RESUMO

Introdução: Ao refletir sobre o cuidado, faz-se necessário reconhecê-lo na perspectiva ontológica de sua existência, para que os profissionais de saúde e de direito possam desenvolver uma prática humana e empática, para além da técnica.

Objetivo: Apresentar um ensaio reflexivo sobre o cuidado face à Judicialização da saúde no cenário atual em tempos de pandemia da Covid-19, a partir do pensar Merleau-Pontyano.
Métodos: Trata-se de uma análise teórico-reflexiva, construída a partir de leituras sobre o cuidado sob a ótica da Judicialização da saúde durante o período pandêmico, disponíveis em artigos científicos, em bases eletrônicas de dados e com base no conceito de cuidado proposto pelo filósofo Merleau-Ponty em suas obras literárias.

Conclusão: O cuidado deve ser entendido como um ato que vai além de procedimentos técnicos, tanto na área da Saúde, quanto na área das Ciência Jurídicas, havendo a necessidade de envolvimento e comprometimento com o outro, bem como deve existir uma ação humanizada e empática para com o próximo. Em tempos de pandemia, analisar a judicialização poderá trazer à discussão a importância de empoderar e dar visibilidade ao enorme contingente da sociedade brasileira que não é assistido pelo Poder Público.

 ABSTRACT

Introduction: When reflecting on care, it is necessary to recognize it in the ontological perspective of its existence, so that health and law professionals can develop a human and empathic practice, beyond the technique.

Objective: To present a reflective essay on the care of the judicialization of health in the current scenario in times of pandemic of Covid-19, from the thinking Merleau-Pontyano.

Methods: This is a theoretical-reflective analysis, constructed from readings on care from the perspective of the judicialization of health during the pandemic period, available in scientific articles, in electronic databases of data and based on the concept of care proposed by the philosopher Merleau-Ponty in his literary works.

Conclusion: Care should be understood as an act that goes beyond technical procedures, both in the area of Health and in the area of Legal Science, with the need for involvement and commitment to the other, as well as there must be a humanized and empathetic action towards others. In times of pandemic, analyzing the judicialization may bring to the discussion the importance of empowering and giving visibility to the huge contingent of Brazilian society that is not assisted by the Public Authority.
